Terms
Roamaloud sends you into the real world on foot and by car. These terms explain what you are buying, what the tours are and are not, and where the responsibility sits when you are out there. Please read the safety sections; they are the ones that matter most.
Who you are agreeing with
Roamaloud is operated by The Tech SLP LLC (“Roamaloud,” “we,” “us”). These terms are an agreement between you and The Tech SLP LLC, and they cover the Roamaloud website, the Roamaloud app, and everything you buy or download through them.
By downloading Roamaloud, using it, or buying a tour or city, you agree to these terms. If you do not agree, do not use Roamaloud.
What you are buying
Roamaloud sells individual tours, full-city packs, whole-park unlocks, and a choose-three-city bundle as one-time purchases. A tour purchase unlocks that tour. A full-city purchase unlocks every tour in that city. A whole-park purchase unlocks every drive in that park. The choose-three bundle lets you select three distinct launched cities; those selections become the cities included in that purchase. Each purchase includes the available languages, lifetime access to the purchased content, and content updates we make available for that same purchased content. Purchases are tied to the Apple App Store or Google Play account used to buy them and may be restored through that store account.
Playback is intended for you and your travel group from the one device running Roamaloud. Refund requests are handled by the app store where the purchase was made, under that store’s refund rules.
Acceptable use
Do not copy, resell, scrape, reverse engineer, redistribute, or publicly rebroadcast Roamaloud packs or narration. Do not use Roamaloud to break the law, harass others, interfere with the service, or bypass purchase and entitlement checks.
You are responsible for your own safety
Moving through the real world carries risks no app can remove: traffic, uneven ground, stairs, weather, heat, cold, water, wildlife, altitude, construction, crowds, crime, closures, and the ordinary unpredictability of other people. By using Roamaloud you knowingly accept those risks, for yourself and for anyone traveling with you.
Stay aware of your surroundings. Obey traffic laws, signals, signs, barriers, fences, and the instructions of police, rangers, staff, and property owners. Nothing in a tour requires you to go anywhere. If a stop, a block, or a whole route feels wrong to you, skip it. The tour continues without it, and your judgment about the place you are standing in beats anything we wrote months earlier.
Roamaloud does not supervise, guide, accompany, monitor, or track you. There is no one on the other end of a tour. We do not know where you are; your location stays on your device, and we cannot summon help. Carry your own way to call for help, and tell someone where you are going.
Routes and content can be out of date
Conditions change faster than content does. Streets close for construction and events, businesses move and shut down, hours and prices change, park roads close for snow and fire, transit reroutes, and a block that was pleasant last season may not be this one. Roamaloud content reflects what we could verify when we wrote and last reviewed it, and it may be wrong or stale by the time you hear it. Verify hours, closures, prices, access rules, transit, fees, and current local conditions yourself before relying on them.
Distances, durations, difficulty, and accessibility notes are estimates to help you choose, not guarantees. Maps, GPS, and the location triggering that starts each story depend on satellites, your device, and conditions we do not control; they will sometimes be inaccurate, delayed, or unavailable. Do not use Roamaloud for navigation in an emergency or as your only means of finding your way.
Never use Roamaloud while driving
Driving tours are built to be listened to, not looked at. Audio starts on its own as you approach each stop, so the tour works with the phone mounted, in a cup holder, or in your pocket. That is the only way it is meant to be used in a moving vehicle.
Do not operate Roamaloud while driving. Set the tour up before you move. If you need to tap, type, read a stop, or look at the map, hand the phone to a passenger, or stop somewhere legal and safe first. Follow every traffic law that applies to you, including your jurisdiction’s rules on phone use, device mounting, and headphones. Some places prohibit wearing them while driving at all.
Driving is your responsibility, always. If following a tour would mean an unsafe or illegal maneuver (a sudden stop, a late turn, a full pullout, a shoulder that is not a parking spot), do not make it. Keep driving and let the tour catch up, or skip the stop. No story is worth a collision.
Night tours, bars, and 21+ content
Some Roamaloud tours are built for the evening, and some cover bars, lounges, and drinking history. That content is informational. We do not serve alcohol, we are not affiliated with the venues, we do not verify that any venue is open or will admit you, and we are not responsible for what happens at, in, or after a visit to one.
After dark the ordinary risks get larger: less light, fewer people around, different crowds, and businesses that close mid-route. Take more care, not less. Where a tour includes alcohol-related content it is intended for people of legal drinking age, which is 21 in the United States. Drink responsibly, never drink and drive, arrange your way home before you need it, and follow the venue’s rules and the law on age and entry.
Parks, deserts, and open country
Park and scenic-drive tours cross places where help is far away. Expect steep and uneven terrain, elevation, extreme heat and cold, storms, flash floods, wildlife, long distances between fuel, water, and services, and roads, trails, and viewpoints that close by season, weather, or fire, sometimes with no notice. Cell coverage is often absent, which is why Roamaloud works offline and also why you may not be able to call anyone.
The land managers set the rules, not us. Follow the National Park Service, state and local authorities, and tribal governments, including posted signs, closures, permits, and fees. Some places we cover are sovereign tribal land. Grand Canyon West is on the Hualapai Nation’s land, with its own rules, fees, photography restrictions, hours, and access decisions, which are entirely theirs to make and can change at any time.
Come prepared: water, fuel, food, a physical map, layers, real footwear, and a charged phone. Location-triggered audio uses GPS continuously and will drain your battery faster than normal use, so start charged and bring a way to recharge.
Your health and fitness
Tours involve walking, sometimes for miles, sometimes on hills, stairs, or rough ground, sometimes in heat or at altitude. We publish distance, duration, and accessibility notes so you can judge a route before you start, but only you know your own body. Decide for yourself what you can safely do, and talk to your doctor if you are unsure. Roamaloud is not medical advice and is no substitute for it.
Who can use Roamaloud
Roamaloud is for adults. Purchases require an adult app store account. If you are under 18, use Roamaloud only with a parent or guardian who agrees to these terms on your behalf and supervises your travel; that adult is responsible for the minor’s use and safety. Roamaloud is not directed at children under 13 and we do not knowingly collect personal information from them. See our Privacy Policy.
No warranties
Roamaloud is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that content is accurate, current, or complete, that a route or place is safe, suitable, or passable, or that the app will be uninterrupted, error-free, or available offline in every condition.
Limits on our liability
To the maximum extent permitted by law, Roamaloud is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or a ruined trip, under any theory of liability.
To the maximum extent permitted by law, Roamaloud is not liable for injury, illness, death, property loss or damage, citation, arrest, or other harm arising out of your travel, your route or stop choices, the condition of any place, the acts of other people, the businesses or land managers you encounter, or your use of the app while moving.
To the maximum extent permitted by law, our total liability for all claims relating to Roamaloud is limited to the amount you paid us for the content the claim relates to.
Some states and countries do not allow the exclusion or limitation of certain warranties or damages, including, in many places, liability for gross negligence, willful misconduct, fraud, or personal injury. Where that is the case, these limits apply only as far as the law allows, the rest of these terms stay in force, and you keep any consumer rights that cannot be waived. Nothing here limits liability we are not permitted to limit.
If your use causes a claim
If your use of Roamaloud, your travel, your conduct, or your breach of these terms leads someone else to bring a claim against us, you agree to defend and indemnify Roamaloud against that claim and its reasonable costs, except to the extent the claim is caused by our own gross negligence or willful misconduct.
Changes to these terms
We may update these terms. When we do, we change the date at the bottom of this page before the update takes effect, and material changes will be brought to your attention in the app. Continuing to use Roamaloud after an update means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except where the mandatory law of your home jurisdiction applies regardless. Disputes are heard in the state or federal courts located in Nevada, and you may always bring a qualifying claim in small claims court.
Before filing anything, please write to hello@roamaloud.com and give us a real chance to fix it. Most problems are a refund, a correction, or a content fix, and we would rather make it right than argue about it.
